Community Contest - Official Rules
PROPERTY BRIDGE COMMUNITY PROMOTION & ADOPTION CONTEST OFFICIAL RULES
1. THE CONTEST: Prizes will be awarded for each month of the Contest Period to the Community within the Participating PropertyBridge Client’s Portfolio ("Client Portfolio") whose staff’s promotion and marketing efforts result in the greatest increase over the previous month in the Community’s payments made using the PropertyBridge Payment system. A Grand Prize will also be awarded to the Community with the highest percentage increase in transactions using the PropertyBridge Payment system over the Contest Period as compared to totals for January 2009. “Client Portfolio” includes all of the properties owned or managed by the Client and therefore, all of Client’s Communities are competing against each other for prizes. A “Community” is a residential real estate complex, condominium owners association or home owners association as defined by Client in its relationship with PropertyBridge. The Contest will run for three months beginning 12:01 AM Pacific Time ("PT") on February 1, 2009 and ends at 11:59 PM PT on April 30, 2009 (the "Contest Period"). Void where prohibited. Subject to all federal, state and local laws.
2. CAN I PARTICIPATE? To be eligible, a Community must be owned or managed by a Participating PropertyBridge Client during the Contest Period with properties active on the PropertyBridge Payment system. By participating, each Community and its staff members agree to be bound by these Official Rules and decisions of PropertyBridge ("Sponsor") which will be final and binding. Sponsor reserves the right to verify to its satisfaction the eligibility of any participant.
3. HOW DO I WIN AND CONTEST CRITERIA? For each month of the Contest Period (February, March, April), the Community for each Client with the first, second and third highest percentage increase in residents’ payments using the Property Bridge Payment system over their property’s previous month totals will win a prize. For instance, for February, the winners will be determined by comparing each Community’s residents’ total transactions using PropertyBridge’s Payment system in January 2009 to the total number in February 2009, with the highest three percentage increases being eligible for the Prize. Likewise, for March, February and March data will be used; and for April, March and April data will be used in the same fashion. The Grand Prize winner for each Client will be selected based on the Community with the highest percentage increase in transactions over the three months of the Contest Period , as compared to total transactions for January 2009. In the event of a tie for any of the monthly prizes, the Community with the highest number of transactions in that month will win. In the event of a tie for the Grand Prize, the Community with the highest number of transactions during the Contest Period will be declared the winner. All PropertyBridge payment transaction options (including credit card, pinless debit, ACH, MoneyGram ExpressPayment service, in-person, phone, and Check Scan payments) will be included in the contest calculation. ExpressPayment service times (via a MoneyGram agent location) are subject to agent hours of operation. In-person and Check Scan payment transactions are subject to Community office hours of operation. To be included in a particular month’s total, the transactions must be received in the PropertyBridge Payment system by 11:59 PT on the last day of the month. Transactions will be deemed received when entered and processed in the Sponsor’s system. For purposes of determining the winners of this Contest, the Sponsor is not responsible for transactions that are late, lost, stolen, misdirected, delayed, destroyed, computer error, electronic or technical malfunction.
4. WHAT PRIZE CAN I WIN?: There are a total of ten (10) prizes for the Contest Period for the Communities of each PropertyBridge Client. All Prizes will be awarded to the Community, with each Community having the discretion as to how to use the prize funds.
a. GRAND PRIZE: One (1) Grand Prize winner per Client will receive Five Hundred Dollars ($500.00).
b. FIRST PLACE PRIZES: Three (3) First Place Prizes: For each of the three months of the Contest Period, One (1) First Place Prize winner per Client will receive One Hundred Dollars ($100.00).
c. SECOND PLACE PRIZES: Three (3) Second Place Prizes: For each of the three months of the Contest Period, One (1) Second Place Prize winner per Client will receive Seventy-Five Dollars ($75.00).
d. THIRD PLACE PRIZES: Three (3) Third Place Prizes: For each of the three months of the Contest Period, One (1) Third Place Prize winner per Client will receive Fifty Dollars ($50.00).
e. REQUIREMENTS TO RECEIVE PRIZE: By participating in the Contest and by accepting a prize, each prize winning Community and the Client releases Sponsor, its parent and subsidiaries, and the officers, directors, employees and agents of each from any and all liability, damages, claims or causes of actions of any kind whatsoever (however named or described) for injuries, damages, or losses to person or property which may be sustained in any connection with participating in this Contest and grant permission to Sponsor, its parent and subsidiaries, to use their Community name, city, and state, for advertising and promotional purposes without additional compensation, except where prohibited.
f. PRIZE DETAILS: All Prizes will be issued in the form of a gift card or check and awarded to the Community c/o Client. All Prizes will be mailed or couriered to the winners’ address held by PropertyBridge within 30 days of the close of the Contest Period. The total value of the Prizes are: $1,175. No Prize is transferable or substitutable. Client and each Community are responsible for all applicable federal, state, or local taxes and any other cost associated with or payable in respect of a prize or the acceptance thereof. The Sponsor reserves the right to report such information to federal, state, or local taxing authorities as may be required by law.
5. LIMITATION ON LIABILITY: No liability is assumed for any human or computer error which may occur in the processing of the transactions for this Contest. If, in the Sponsor’s opinion, there is any suspected or actual evidence of tampering with any portion of the Contest, or if technical difficulties compromise the integrity of the Contest, or an unauthorized intervention or other cause beyond its control affects the proper administration, play or conduct of the Contest, the Sponsor reserves the right, at its sole discretion, to (a) suspend or cancel the Contest in part or its entirety; and/or (b) void any suspected transactions. Sponsor is not responsible for any typographical or other error in the printing of these Official Contest Rules or any materials associated with the administration of the Contest or the announcement of prizes.
6. DISPUTE RESOLUTION: Each participant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Minnesota; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will a participant be permitted to obtain awards for, and each participant hereby waives all rights to claim punitive, incidental, or consequential damages, any other damages other than actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Contest Rules, or the rights and obligations of participants and the Sponsor in connection with the Contest, shall be governed by and construed in accordance with the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Minnesota or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Minnesota.
7. PRIVACY: The Sponsor respects entrants’ right to privacy. The Sponsor will only use the information provided by entrants to conduct and promote the Contest. Information participants provide to Sponsor will be used to communicate with participants in relation to this Contest as well as for other purposes as described in Sponsor’s Privacy Policy. Client and Community’s name, city and state may be posted on the Sponsor’s website, on each of Sponsor’s Client’s Community web portal, and in press releases.
8. WINNERS LIST: To obtain the names of the winners, send a self-addressed, stamped envelope to be received by May 30, 2009 to: PropertyBridge “Community Manager Contest Winners List”, 475 14th Street, Suite 600, Oakland, CA 94612.
9. SPONSOR: This Contest is sponsored by PropertyBridge, Inc., a Moneygram Company, 475 14th Street, Suite 600, Oakland, CA 94612. Sponsor reserves the right to cancel the Contest at any time and substitute another promotion in its place.
